These Terms and Conditions govern the provision of landscaping services provided by Umfeld Landscaper from (“we,” “us,” or “our”) to the client (“you,” “your”). By booking our services, you agree to these Terms and Conditions.

Before any work begins, a written agreement or estimate may be provided. This document will outline the scope of services, pricing, and any other terms that apply to the project. All agreed-upon services and costs will be listed clearly, and by accepting the estimate, you agree to proceed with the work under the terms of this agreement.

We offer a 1 month warranty on certain types of landscaping work, such as plant installations and hardscaping. This warranty covers the replacement of plants that fail under normal conditions or the repair of faulty workmanship. The warranty does not cover damage caused by neglect, weather-related events (e.g., storms, floods), or other external factors.
Any materials (e.g., plants, soil, mulch, stones, etc.) provided for the landscaping work remain the property of Umfeld Landscapers until full payment for the services is received. In the case of non-payment, we reserve the right to remove any materials or halt the work until payment is made.
We may employ subcontractors to perform certain aspects of the work. We ensure that all subcontractors are qualified to provide the services we offer. You will not be charged additional fees for subcontractor services unless agreed upon in writing.
If you wish to make changes to the agreed-upon scope of work, please notify us as soon as possible. We will provide an updated estimate reflecting any changes and obtain your approval before proceeding with the altered services. Additional charges may apply for changes outside the original agreement.
We respect your privacy and will handle your personal data in accordance with our Privacy Policy. By engaging our services, you consent to our collection and use of your data as outlined in the policy.
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including, but not limited to, acts of God, weather events, fire, flood, strikes, or governmental actions.
Any disputes arising out of or related to these Terms shall first be addressed through informal negotiation. If the dispute cannot be resolved through negotiation, it will be settled through mediation or arbitration in accordance with the rules of local governing body. The prevailing party in any legal action shall be entitled to recover their reasonable attorney’s fees and costs.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
We reserve the right to update or modify these Terms at any time. When changes are made, we will post the updated Terms on our website with a revised effective date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
